Industrial Design

Industrial design, sometimes referred to as a design patent, has increasingly become one of the battlefronts in intellectual property in recent times. It describes a form of intellectual property protection over the visual aspects of an article, and can include its design, shape, pattern, colors and ornamentation.

Once an article has been successfully registered as a Registered Design, its owner has the right to make, sell and import the products, or grant power to another party to do so. No other party may then perform these activities for commercial gain without the consent of the IP Owner.

Industrial Design protection can cover both physical objects such as household goods, or even virtual products such as the user interface of the software. Protection is accorded for an initial 5 years, after which 5 years extensions can be applied and paid for up to 25 years.
