NPV is an acronym for NEW PLANT VARIETY. NPV is part of INTELLECTUAL PROPERTY and its govern under New Plant Varities Act 2004 (NPVA).

What is NPV all about???…read below 😄.

Let say you have created/breeded a NEW PLANT (ex. a NEW type of “BUNGA KANTAN”, reasons that the price of Bunga Kantan is currently unimaginable EXPENSIVE). Your new spesies of BUNGA KANTAN is enable to produce 50 cloves of flower at 1 time. How you can protect it (i.e. your new breed of BUNGA KANTAN?).

You should register you NEW BREED of BUNGA KANTAN under NPV in order for you to entitle for EXCLUSIVE COMMERCIAL RIGHTS. Registration of NPV is governed under NPVA at the Ministry of Agriculture. Provided that your NPV fullfils the registration criteria, as follows :

1. NEW;
2. Dinstinct; &
3. Uniform and Stables…(“NDUS”).
.
The registration of NPV must be filed in the country which the Breeder feels there is a “COMMERCIAL MARKET” for the NEW type of “BUNGA KANTAN” to be exploded.

Among the EXCLUSIVE RIGHTS granted to the Breeder/Owner of NPV are as follows :

1. Enjoys the right of PRODUCTION @ RE-PRODUCTION of the NPV (Can stop others to cultivate the same NPV in Malaysia);
2. Sell the NPV (Including offering, marketing, distributing and etc);
3. Exporting & Importing the NPV;
4. Conditioning the NPV for the purpose of propagation (for all methods of propagation processes/tecniques).
5. At some condition, the EXCLUSIVE RIGHT is extendable to protect any material derived from material harvested from a REGISTERED NPV. Ex. If you find that, any part of your NEW BREED of BUNGA KANTAN is ILLEGALLY being used as an ingredient for a medical product, you as the Registered Owner/Breeder has the right to take action vs the infringers.
6. The NPV Owner/Breeder has the right to prevent others from IMPORTING the same kind of BUNGA KANTAN from any other country even though his/her BUNGA KANTAN is not registered in that country.
