Sometimes, a company or entity may decide that a patent grants too little time for them to profit from an invention, and feel fairly confident they can keep other parties from learning the secrets of their invention.

In such cases, these entities may instead opt for intellectual property protection in the form of trade secrets. This entails the owner of the trade secret taking steps such as making the secret known only to a few select parties or individuals, backed by contracts in the form of strong confidentiality agreements.

Usually, only inventions that are particularly resistant to reverse engineering are suitable for protection in the form of trade secrets, such as recipes in the F&B industry and manufacturing processes in the pharmaceutical industry, which involves ingredients as well as specific technical processes to produce.

There are of course limitations to the protection provided by trade secrets. It does not stop others from innovating and independently discovering the secret themselves, after which they are free to commercialize the idea on their own and even file a patent on it.
